The website www.flowforwardconsultingllc.com (the "Website") and any content on it are owned and operated by FlowForward Consulting, LLC, an Oklahoma limited liability company ("FlowForward," "we," "us," or "our"). Please read these Terms & Conditions before using the Website. By visiting or using the Website, you ("you" or "your") are stating that you have read and agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Website.
1. Acceptance and Changes to These Terms
A. Eligibility. You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use this Website. By using the Website, you represent that you meet these requirements. Any use of this Website by anyone under 18 is unauthorized.
B. Updates. We may update these Terms & Conditions at any time without prior notice. Continued use of the Website after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
C. Relationship to Engagement Agreements. This Website provides general information about FlowForward's services. It does not, by itself, create a consulting relationship or any obligation on our part to perform services. Any engagement for consulting services (including FlowFind, FlowVision, FlowPath, FlowBuild, FlowState, or FlowLine) is governed exclusively by a separate, signed engagement agreement or statement of work between FlowForward and the client organization (an "Engagement Agreement"). If any conflict exists between these Terms and an Engagement Agreement, the Engagement Agreement controls for matters related to that engagement.
D. Email Communications. If you provide your email address through the Website, including to access a free resource, you consent to receive emails from us regarding our services, insights, and updates. You may withdraw this consent at any time using the unsubscribe link in our emails or by contacting us directly. Please see our Privacy Policy for details on how we handle your information.
2. Intellectual Property
A. Our Content. The Website and its content, including but not limited to the FlowState Transformation Path framework, the FlowFind, FlowVision, FlowPath, FlowBuild, and FlowState names, the FlowLine name, our diagnostic tools and assessments, articles, graphics, layout, branding, and all other original materials on the Website (collectively, "Content"), are owned by FlowForward Consulting, LLC and are protected by U.S. copyright, trademark, and trade secret law.
B. Limited License to You. We grant you a limited, revocable, non-transferable, non-exclusive license to access and use the Content for your own personal or internal organizational reference only. You may not copy, reproduce, distribute, publicly display, modify, create derivative works from, sell, or otherwise commercially exploit any Content without our prior written consent. Unauthorized use may result in termination of your access to the Website and legal action to the fullest extent of the law.
C. Feedback and Submissions. If you submit comments, testimonials, feedback, or other content to us, for example in response to an email, a case study interview, or a survey, you grant FlowForward a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, edit, and publish that submission in connection with our business, with or without attribution. You retain ownership of anything you submit. You are not assigning your underlying intellectual property rights to us, and you will not be entitled to compensation for our use of your submission unless we separately agree to that in writing.

You agree not to: (a) use the Website for any unlawful purpose; (b) attempt to gain unauthorized access to the Website, our systems, or any account not belonging to you; (c) interfere with the Website's operation, including through malicious code, scraping, or excessive automated requests; or (d) misrepresent your affiliation with FlowForward or any organization. From time to time, we may offer free resources on the Website in exchange for your contact information, including the FlowForward Self-Assessment, the Operational Cost Estimator Tool, and the FlowState Transformation Path Overview (each, a "Free Resource"). Free Resources are provided for general informational and educational purposes and are licensed to you for your organization's internal, non-commercial use only. You may not resell, republish, or redistribute a Free Resource, in whole or in part, without our written permission. Results generated by a Free Resource, such as a self-assessment score or a cost estimate, are illustrative only and are not a substitute for a full diagnostic engagement.
5. No Professional, Medical, or Protected Health Information Advice
A. General Disclaimer. The Content is provided for general informational and educational purposes related to non-profit healthcare operations. It is not a substitute for professional legal, financial, medical, clinical, or accounting advice specific to your organization. FlowForward is not a law firm, accounting firm, or medical provider, and nothing on the Website should be relied upon as such advice. You should consult your own qualified professionals regarding your organization's specific legal, financial, clinical, or regulatory obligations.
B. No Access to Protected Health Information. FlowForward's Website, Free Resources, and general consulting methodology do not involve the collection, storage, or transmission of Protected Health Information ("PHI") as defined under HIPAA. If a specific engagement requires FlowForward to access, use, or handle PHI on a client's behalf, that access will be governed by a separate, signed Business Associate Agreement executed before any such access occurs. Nothing on this Website should be understood as an agreement by FlowForward to act as a Business Associate absent that separate written agreement.
C. No Guaranteed Outcomes. Operational transformation outcomes depend on many organization-specific factors, including leadership engagement, staffing, resources, and execution. We do not guarantee any specific result, efficiency gain, cost savings, or timeline from use of the Website, a Free Resource, or any engagement, and your use of our Content is voluntary.
6. Testimonials and Case Studies
Testimonials and case studies on the Website reflect the real, individual experiences of specific client organizations at a specific point in time. They are not a guarantee that any other organization will achieve similar results, as outcomes depend on each organization's unique circumstances. We identify client organizations in testimonials and case studies only with their consent.
7. Website Availability
We do not guarantee that the Website will be available at all times or free of errors, delays, or interruptions. We may modify, suspend, or discontinue all or part of the Website, including any Content, at any time without notice or liability to you.
8. Information You Provide
A. Accuracy. If you provide information to us through the Website, such as your name, email address, or organization, you represent that the information is accurate and belongs to you, and that you have the authority to provide it on behalf of any organization you represent.
B. Account Security. If we provide you with login credentials to access purchased materials or a client portal, you are responsible for maintaining the confidentiality of those credentials and for all activity that occurs under your account.
9. Payments and Online Purchases
A. Processing. Payments made through the Website are processed by our third-party payment processor, Stripe. We do not store your full payment card information. Your use of Stripe's services is also subject to Stripe's own terms and privacy policy.
B. Accuracy of Billing Information. You agree that any billing information you provide is accurate and that you are authorized to use the payment method provided. You remain financially responsible for charges made using information you submit.
C. Confidentiality of Information. WE TAKE REASONABLE PRECAUTIONS TO PROTECT INFORMATION YOU PROVIDE, BUT WE CANNOT GUARANTEE ABSOLUTE SECURITY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR UNAUTHORIZED ACCESS TO YOUR INFORMATION RESULTING FROM CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL.
10. Third-Party Links and Tools
The Website may reference or link to third-party tools, platforms, or websites, such as Calendly for scheduling or DocuSign for document signing, for your convenience. 12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FLOWFORWARD CONSULTING, LLC AND ITS MEMBERS, AGENTS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE OR ANY CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION DOES NOT APPLY TO LIABILITY ARISING UNDER A SEPARATE, SIGNED ENGAGEMENT AGREEMENT, WHICH IS GOVERNED BY ITS OWN TERMS.
13. Indemnification
You agree to indemnify and hold harmless FlowForward Consulting, LLC and its members, agents, and contractors from any claims, damages, losses, or expenses, including reasonable attorneys' fees, arising from your violation of these Terms or your misuse of the Website.
14. Termination
We may suspend or terminate your access to the Website at any time, for any reason, with or without notice. This section does not affect the terms of any active Engagement Agreement, which is governed by its own termination provisions.
15. Governing Law and Dispute Resolution
A. These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-law principles.
B. Any dispute arising from these Terms or your use of the Website (excluding disputes arising under a separate Engagement Agreement, which are governed by that agreement) will first be addressed through good-faith informal negotiation. If unresolved within thirty (30) days, the dispute will be resolved by binding arbitration administered in Oklahoma City, Oklahoma under the rules of the American Arbitration Association, rather than in court, except that either party may bring an individual claim in small claims court where eligible.
C. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
16. Privacy and Your Data Rights
Our collection and use of your personal information is described in our Privacy Policy. If you wish to make a request regarding your personal data, such as a request to access, correct, or delete your information, please use our Data Subject Access Request process described in the Privacy Policy or contact us at the email below.
17. Entire Agreement; Contact
These Terms, together with our Privacy Policy and any applicable Engagement Agreement, constitute the entire agreement between you and FlowForward Consulting, LLC regarding your use of the Website.
